Article 1 (Purpose)
The purpose of these Terms and Conditions of Use (“T&C”) is to establish guidelines regarding the rights, duties, and responsibilities of Users utilizing the internet-related services (hereinafter referred to as the “Services”) provided by the cybermall (hereinafter referred to as the “Mall”) operated by the company.
Unless transactions contradict their nature, these terms shall also apply to e-commerce transactions conducted through PC communication, wireless communication, and other electronic means.
Article 2 (Definitions)
① “Mall” refers to a virtual business site established by the company to provide goods or services (hereinafter referred to as “Goods and Services”) to Users using computers and information communication facilities. The term may also refer to the company operating the cybermall.
② “User” refers to any person who accesses the Mall and uses the Services provided by the Mall in accordance with these T&C.
Article 3 (Display, Explanation and Amendment of Terms and Conditions of Use)
① The Mall shall, for easy recognition by Users, display the contents of these T&C, the name of the company and representative, business address (including an address for handling customer complaints), phone number, fax number, email address, business license number, e-commerce permit number, and the name of the personal information manager on the main page of the Mall. The contents of these T&C may be displayed through a linked page.
② Prior to the User’s final agreement to these T&C, the Mall shall provide a separate link or pop-up screen to allow the User to review important details such as cancellation rights, delivery responsibilities, and refund conditions.
③ The Mall may amend these T&C within the permissible range without violating applicable laws, including the Act on Consumer Protection in Electronic Commerce and other applicable consumer protection laws.
④ The Mall shall specify the effective date and reasons for any amendment and post such information on the initial screen at least 7 days prior to the effective date. If an amendment is disadvantageous to Users, the Mall shall provide at least 30 days’ prior notice and clearly explain the changes.
⑤ Amendments to these T&C shall apply to contracts concluded after the effective date of the amendment. Contracts concluded before the effective date shall remain subject to the previous T&C unless otherwise agreed between the User and the Mall.
⑥ Matters not specified in these T&C shall be governed by applicable laws and regulations of the Republic of Korea.
Article 4 (Provision & Replacement of Service)
① The Mall shall perform the following duties:
Provide information regarding Goods and Services and conclude purchase contracts.
Deliver Goods and Services under purchase contracts.
Perform other duties designated by the Mall.
② The Mall may replace or change Goods and Services if they are sold out or their technical specifications are revised. In such cases, the Mall shall promptly announce the changes and their effective date on the relevant product or service page.
③ If Goods and Services are replaced due to changes in technical specifications or because they are sold out, the Mall shall promptly notify affected Users.
④ The Mall shall compensate Users for damages caused by such changes where required by applicable law, unless the Mall proves that the event was not caused by its intent or negligence.
Article 5 (Suspension of Service)
① The Mall may temporarily suspend its Services due to maintenance, replacement or repair of computers or telecommunications equipment, interruption of communications, or other technical reasons.
② The Mall shall compensate Users for damages caused by a temporary suspension of Services where required by applicable law, unless the Mall proves that the event was not caused by its intent or negligence.
③ In the event of discontinuation of business, conversion of business operations, merger, or other significant changes, the Mall shall notify Users in accordance with applicable laws and regulations.
Article 6 (Application for Purchase)
① The User may apply for a purchase in the following or a similar manner, and the Mall shall provide the necessary information in an easy-to-understand manner:
Search for and select Goods and Services.
Enter the recipient’s name, address, phone number, email address or mobile phone number.
Review these T&C, cancellation policies, delivery fees, installation fees, and other applicable conditions.
Agree to these T&C and confirm the relevant purchase conditions.
Submit and confirm the purchase request.
Select a payment method.
② If it is necessary for the Mall to provide or entrust a User’s personal information to a third party for the purpose of processing a purchase, the Mall shall obtain the User’s consent where required by applicable law and provide information regarding the recipient, purpose of use, information provided, and retention period.
Article 7 (Conclusion of Contract)
① The Mall may refuse a purchase request in any of the following circumstances:
False or incomplete information has been provided.
The purchase involves Goods and Services prohibited by applicable law.
Accepting the purchase request may cause technical or operational difficulties.
In the event of a contract with a minor, the Mall may provide notice that the contract may be cancelled by the minor or their legal representative if consent from a legal representative has not been obtained.
② The contract shall be deemed concluded when the Mall’s acceptance of the purchase request is delivered to the User.
③ The Mall’s acceptance shall include confirmation of the User’s purchase request, availability of the Goods and Services, and information regarding correction or cancellation of the purchase request.
Article 8 (Payment Method)
Payment for Goods and Services purchased through the Mall may be made using payment methods supported by the Mall, including:
Bank transfer.
Debit or credit card.
Electronic payment services.
Other payment methods made available by the Mall.
The Mall shall not impose additional fees solely based on the User’s selected payment method unless permitted by applicable law.
Article 9 (Notice of Receipt, Change and Cancellation of Purchase)
① The Mall shall provide the User with confirmation after receiving a purchase request.
② If the confirmation differs from the User’s intended purchase, the User may request a change or cancellation. If the request is made before delivery, the Mall shall process it without unreasonable delay. If payment has already been made, the applicable cancellation and refund provisions of these T&C shall apply.
Article 10 (Provision of Goods and Services)
① Unless otherwise specified, the Mall shall take necessary measures for production, packaging, and delivery of Goods and Services within the period specified at the time of purchase.
② The Mall shall provide information regarding the delivery method, delivery charges, and expected delivery period for the Goods and Services purchased by the User.
If the Mall exceeds the stated delivery period, it shall handle the matter in accordance with applicable laws and regulations.
Article 11 (Refund)
If Goods and Services are sold out, unavailable, or otherwise cannot be provided to the User, the Mall shall notify the User without unreasonable delay.
If payment has already been made, the Mall shall refund the payment or take the necessary measures in accordance with applicable laws and regulations.
Article 12 (Cancellation of Purchase)
① The User may cancel a purchase within the period permitted under the Act on Consumer Protection in Electronic Commerce and other applicable laws.
② The User may not return or exchange Goods and Services in the following circumstances, except where otherwise required by law:
The Goods have been lost or damaged due to the User’s fault. However, damage to packaging solely for the purpose of inspecting the Goods shall not necessarily restrict cancellation.
The value of the Goods has significantly decreased due to the User’s use or consumption.
The value of the Goods has significantly decreased over time to the extent that resale is difficult.
The packaging of Goods that can be reproduced or replaced with identical Goods has been materially damaged.
③ Where required by applicable law, restrictions on cancellation shall not apply unless the Mall has clearly informed the User of such restrictions or taken other legally required measures.
④ If the Goods and Services differ from their advertised description or the terms of the purchase contract, the User may cancel the purchase within the period permitted by applicable law.
Article 13 (Effect of Cancellation of Purchase)
① Upon receiving returned Goods from the User, the Mall shall refund the payment within the period required by applicable law.
② If the User paid by credit card, electronic payment service, or another payment method, the Mall shall take the necessary steps to cancel or reverse the payment where applicable.
③ If the purchase is cancelled due to the User’s change of mind, the User shall bear the return shipping costs unless otherwise stated.
If the cancellation is due to Goods differing from their advertised description or the terms of the purchase contract, the Mall shall bear the return shipping costs where required by applicable law.
④ The Mall shall clearly indicate who is responsible for delivery and return shipping fees in the event of cancellation.
Article 14 (Protection of Personal Information)
① The Mall shall collect only the minimum amount of personal information necessary to provide its Services and process purchases.
② The Mall shall collect and use personal information only for purposes necessary to process purchases, payments, delivery, customer inquiries, refunds, exchanges, and other Services provided by the Mall.
③ Where required by applicable law, the Mall shall obtain the User’s consent before collecting or using personal information and shall inform the User of the purpose of such collection and use.
④ The Mall shall not use personal information for purposes other than those for which it was collected. If personal information is to be used for a new purpose or provided to a third party, the Mall shall provide notice and obtain consent where required by applicable law.
⑤ Users may request access to or correction of their personal information held by the Mall, subject to applicable laws.
⑥ The Mall shall take reasonable security measures to protect Users’ personal information against loss, theft, leakage, alteration, or unauthorized disclosure.
⑦ The Mall and any third parties processing personal information on its behalf shall destroy or delete personal information when the purpose for which it was collected has been fulfilled, except where retention is required by law.
Article 15 (Obligations of the Mall)
① The Mall shall comply with applicable laws and these T&C and shall make reasonable efforts to provide Goods and Services in a stable manner.
② The Mall shall maintain appropriate security measures to protect Users’ personal and payment-related information.
③ The Mall shall be responsible for damages caused by unlawful or misleading advertising where required by applicable law.
④ The Mall shall not send unsolicited commercial communications to Users in violation of applicable law.
Article 16 (Obligations of User)
Users shall not:
Provide false information when placing an order or submitting information.
Use another person’s personal information without authorization.
Alter information displayed on the Mall without authorization.
Transmit or display unauthorized programs or information through the Mall.
Infringe the copyrights or intellectual property rights of the Mall or any third party.
Interfere with the operation of the Mall or harm the reputation or rights of the Mall or any third party.
Disclose or display unlawful, indecent, violent, or otherwise prohibited content through the Mall.
Article 17 (Copyright & Limitation of Use)
① Copyright and other intellectual property rights in works produced by the Mall shall belong to the Mall unless otherwise stated.
② Users may not reproduce, transmit, publish, distribute, broadcast, commercially exploit, or permit any third party to use information or content owned by the Mall without prior consent.
③ If the Mall uses copyrighted works belonging to a User, such use shall be handled in accordance with applicable law and any agreement between the Mall and the User.
Article 18 (Resolution of Dispute)
① The Mall shall establish and operate procedures for handling Users’ opinions, complaints, and consumer disputes.
② The Mall shall make reasonable efforts to address Users’ complaints promptly. If a matter cannot be resolved promptly, the Mall shall provide information regarding the reason for the delay and the expected resolution process.
③ Disputes between the Mall and Users may be referred to the Fair Trade Commission or another competent consumer dispute mediation organization in accordance with applicable laws.
Article 19 (Jurisdiction & Governing Law)
① Jurisdiction over disputes arising from e-commerce transactions between the Mall and a User shall be determined in accordance with applicable laws of the Republic of Korea.
② These T&C and any disputes arising from e-commerce transactions between the Mall and a User shall be governed by the laws of the Republic of Korea.
Collection and Use of Personal Information
1 Purpose of Collection and Use of Personal Information
SAL collects and uses personal information for the purposes of processing and fulfilling guest orders, including order confirmation, payment processing, product delivery, and customer support related to purchases.
2 Personal Information Collected
SAL may collect the following information when you place an order as a guest:
Name, shipping address, phone number, and email address.
3 Retention and Use of Personal Information
As a general rule, personal information will be deleted without delay once the purpose for which it was collected has been fulfilled. However, certain information may be retained for the periods required under applicable laws and regulations.
• Records relating to contracts, cancellations, and withdrawals of offers Retention Period: 5 years
• Records relating to payments and the supply of goods Retention Period: 5 years
• Records relating to consumer complaints and dispute resolution Retention Period: 3 years
4 Consent
You have the right to refuse the collection and use of your personal information. However, if you do not agree to the collection and use of the information required to process your order, you may not be able to use the guest checkout service.
